The Memorandum of Understanding on Small Cetaceans in the North Sea was adopted at the Third International Conference on the Protection of the North Sea, at The Hague in March 1990 and was adopted, in part, as an interim measure pending the adoption of a formal agreement under the auspices of the Convention on Migratory Species. (Discussions under that agreement on small cetaceans in the North and Baltic Seas had taken place at the first Conference of the Parties to the Convention in 1985, and a draft agreement was prepared, but work on it was abandoned at the second Conference of the Parties in 1988 because of irreconcilable differences over its content and scope).

In the Memorandum, the participants in the International Conference undertook to cooperate with the Baltic Sea States on elaborating an agreement under the Bonn Convention and, pending such an agreement, to apply interim conservation measures set out in an Annex to the Memorandum. Those measures related to a number of matters, including: the release of accidentally caught cetaceans; habitat protection, including curbing activities which are harmful to the marine environment; the reduction of bycatches and discarding of fishing gear; scientific research; and the promotion of information and public awareness campaigns.
